Acceptance of Terms

By accessing or using flocc — whether as a host (someone with an account who creates events) or as a guest (someone who views an event page or submits an RSVP) — you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

Eligibility

flocc is intended for users who are at least 13 years old. By using flocc, you represent that you meet this age requirement. flocc is not directed at children under 13, and we do not knowingly collect personal information from them. If you are under 18, you represent that a parent or guardian has consented to your use of the service.

Accounts and Account Security

• You are responsible for keeping your login details secure. Do not share your password.
• You must provide an accurate email address. We use it only for account access, password resets, and event-related communications.
• Accounts are personal — one person, one account.
• Account registration is open to anyone. This may change as the product evolves.
• Notify us immediately if you believe your account has been compromised.

Use of the Service

flocc is a web-based tool for creating simple event pages, collecting RSVPs, and coordinating times with the people you've invited. It is intended for personal and small-group social use — not for commercial events, large-scale marketing, or ticket sales.

Because we're in beta, some features may be incomplete or subject to change. Known limitations during this beta period:

• Payment processing and ticketing features are not yet fully enabled for all users.
• The app does not yet support recurring events.
• Some flows may require manual steps or have rough edges that will be smoothed out in later versions.

Acceptable Conduct

• Don't post content that is illegal, harmful, deceptive, or that violates someone else's rights.
• Don't use flocc for spam, automated bulk invitations, or any activity that could harm other users or the service.
• Profile photos and cover images you upload should be images you have the right to use.
• Don't impersonate another person or organisation.
• Don't attempt to access another user's account or event data without authorisation.

Gathering Hosts and Guests

flocc helps with planning, but we are not the organizer of any event created through the platform.

• Hosts are fully responsible for their gatherings — including safety, communication, logistics, and any agreements made with guests.
• Guests participate at their own discretion. flocc has no visibility into what happens at events and assumes no liability for anything that occurs at or in connection with an event.
• flocc is not responsible for injuries, property damage, cancellations, or disputes that arise between hosts and guests.
• When adding guests by phone number, hosts confirm that they have a relationship with those individuals and a legitimate reason to contact them in connection with a real gathering.

User Content

• You retain ownership of any content you create or upload — event details, descriptions, guest messages, photos, and anything else you add to the platform.
• By posting content on flocc, you grant us a limited, non-exclusive, royalty-free license to store, display, and use that content within the platform for the purpose of operating the service for you and your guests.
• flocc does not claim ownership of your content. We will never sell it or use it for advertising.
• We may use anonymized, aggregated usage patterns (never personal content) to understand how the product is being used and improve it.

Invitations and Communications

• Guests who submit an RSVP provide their name, email address, and response. They may also optionally provide a phone number and opt in to SMS notifications for that event.
• Guest information is shared with the host of that event and is used only to manage that event's guest list and related communications.
• Guests are responsible for the accuracy of the information they submit.
• If a guest wants their RSVP data removed, they can contact the host or reach us at support@floccwithfriends.com.

SMS Messaging

SMS is optional and requires explicit consent. flocc sends transactional, gathering-related messages — not third-party marketing messages. Messages may include invitations, RSVP updates, reminders, verification messages, scheduling coordination, and event-related notifications from the host.

How consent is obtained

Guests receive SMS messages only if they have explicitly opted in by checking the SMS consent checkbox at the time they provide their phone number during an RSVP or plan join on flocc. The opt-in clearly describes the flocc Notifications program and the types of messages they will receive. Consent is always optional — checking the box is never required to complete an RSVP, use flocc, or attend an event.

Hosts may also add guests to their event by entering a guest's phone number. Recipients of host-initiated invitations receive a clear message identifying the event and the host, with instructions to reply STOP to opt out immediately.

Users are responsible for providing a mobile number they are authorised to use to receive SMS messages.

Key terms

Consent to receive SMS messages is not required as a condition of purchasing any goods or services or using the flocc platform.

You may opt out of SMS at any time by replying STOP. Opting out of SMS will limit SMS-based gathering notifications but will not stop any email communications you may receive from flocc and will not prevent you from using flocc through other available channels.

Privacy commitments for SMS

• flocc does not use SMS for marketing or promotional advertising.
• Phone numbers are never sold.

flocc uses third-party providers, including Twilio, to deliver SMS communications. Delivery is not guaranteed and may be affected by carrier availability. Email Communications

We may send transactional emails for password resets, event invitations, RSVP confirmations, and host updates. We do not send marketing or promotional emails. All email communications are directly related to events and gatherings on the flocc platform.

Payments and Fees

flocc is free to use during the current beta period. Some features may become paid in the future; we will communicate pricing changes to account holders before they take effect.

When payment features are enabled, payments are processed by Stripe, a third-party payment provider. flocc does not store raw payment card data. By using paid features, you also agree to Stripe's terms of service.

Intellectual Property

• You retain ownership of any content you create or upload on flocc.
• The flocc name, logo, and application code are owned by flocc with friends LLC. You may not copy, reproduce, or distribute them without permission.
• flocc does not claim ownership of user-created content. We will never sell it or use it for advertising.

Third-Party Services

flocc integrates with third-party services including Twilio (SMS), Resend (email), Google Maps (location), and Stripe (payments). These services are governed by their own terms of service and privacy policies. flocc is not responsible for the practices of these third-party providers.

Beta Service

• We do not guarantee that the service will be available at all times or without interruption.
• We may update, change, or remove features — including from the installed PWA — without prior notice.
• We may suspend or shut down the service at any time — we'll do our best to give advance notice if so.
• We are not liable for loss of data, missed events, or any other indirect consequences of the service being unavailable or behaving unexpectedly.
• The app is not suitable for events where failure or data loss would have serious consequences.

Suspension and Termination

We reserve the right to suspend or delete accounts that violate these terms, engage in abusive behavior, or use the service in ways that harm others. We'll aim to be fair and reach out first if something seems unintentional.

Disclaimers

flocc is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements.

Limitation of Liability

To the fullest extent permitted by law, flocc with friends LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of flocc, including but not limited to loss of data, missed events, or damages resulting from events created or attended through the platform.

Indemnification

You agree to indemnify and hold flocc with friends LLC harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of flocc, your violation of these terms, or your violation of any third party's rights.

Governing Law

These Terms of Use are governed by the laws of the United States. Any disputes arising from these terms or your use of flocc shall be resolved in accordance with applicable law.

Privacy

How we collect and use personal data is covered in our Privacy Policy. These Terms of Use and the Privacy Policy together describe your relationship with flocc.

Changes to the Terms

We may update these terms as the product evolves. We'll update the "Last updated" date below when we do. Continued use of flocc after a change means you accept the updated terms.
